Use of this website implies your full acceptance of this legal notice, whether you choose to place an order or register with Proflex.
If you do not accept these terms, please do not use this website.
1 Introduction
1.1. These terms and conditions apply to all transactions between us and you. They do not affect your statutory rights. Please read carefully.
1.2. You can access most areas of this website without registering your details with us. If you sign up, only part of the membership area will be available to you.
1.3. By accessing any part of this website, you are deemed to have fully accepted this notice. If you do not fully accept this notice, you must leave this website immediately.
1.4. Proflex may revise the Notices at any time by updating this Terms and Conditions page. You should check these terms and conditions from time to time to see the latest legal notice as it is binding on you.
2. Customer Sales
2.1. Subject to your compliance with these terms and conditions, we will treat each order of your merchandise as an offer to purchase.
2.2. Please note that verbal confirmation does not constitute a formal order confirmation or order acceptance. We may reject all or part of an order for any reason. We will notify you in person or by phone or email that your order has been accepted.
2.3. We may use certain information about you, or ask you to provide additional information, such as name, telephone number and address, in deciding whether to accept your order.
2.4. If your payment cannot be properly authorized, we will notify you and may invite you to pay by other means. Please note that products, prices and offers in our store may differ from those on our website.
2.5. The total cost of your order will be the price of the product. The total cost does not include additional service charges such as installation and delivery charges (for some products). Note: Most products include delivery charges, we will notify you when you place your order.
2.6. Whether you have confirmed the order or not, the total price will be specified when you place the order. We reserve the right to adjust prices to take into account any increase in supplier prices or the imposition of any taxes or duties, or the wrong price of goods due to errors or omissions, whether the order is confirmed or not. We will notify you of the correct price and give you the opportunity to cancel your order. All prices are inclusive of VAT and delivery charges and will be shown when the order is placed.
2.7. Product prices, quotations and products are subject to availability and are subject to change before we accept your order (but not after). If a product is out of stock, we may offer you other options.
2.8. All product specifications, images, descriptions and other information communicated to you by Proflex, whether displayed on our price tags, computer systems and/or website or by telephone, are published by suppliers, manufacturers, things, provided by public relations staff, or sources from the public domain. It is our intention that all information be as accurate and up-to-date as possible. However, from time to time we may make or discover errors in product prices or descriptions; therefore, we cannot guarantee the reliability or accuracy of the information communicated. If we find such an error in your order, we will notify you as soon as possible and ask you if you want to continue or cancel your order.
2.9. Complete product details can be obtained from the manufacturer’s manual or website. All accessories included with the product should be updated or changed at the manufacturer’s discretion. We will supply the product that the manufacturer provides to us.
2.10. We accept pay by bank transfer. We cannot ship until payment is received, which may take up to 14 days.
2.11. All goods and services are subject to availability and may be withdrawn at any time. If we are unable to provide goods and services for any reason, we will not charge you and we will refund any money paid for it. We recommend that you do not make an appointment with a person/worker for installation until you have received the product and inspected it for damage and satisfaction.
3. Price
3.1. The price of any product will be displayed on our website or quoted via email.
3.2. Product prices do not include delivery charges, which will be listed and added to the total.
3.3. Product prices may change at any time, but changes will not affect orders for which we have sent you a delivery confirmation.
3.4. Our website contains a large number of products, and despite our best efforts, it is always possible that some of the products listed on our website may be priced incorrectly. We usually verify the price during the order placement process. If the correct price of the product is higher or lower than the price stated on our website, we will usually decide to contact you for instructions before sending the product, or reject your order and notify you of the rejection.
3.5. We are not obligated to supply you with products at incorrect product pricing, even if we have sent you a delivery confirmation, if the product is clearly priced incorrectly, we will notify you and ask for instructions or cancel the order.
4. Delivery
4.1. Delivery charges are charged for the delivery of goods and we will endeavour to keep shipping charges as low as possible.
4.2. All quoted delivery charges apply to most addresses. Special regions or overseas will incur additional charges and may also delay delivery. Delivery times are usually Monday to Saturday during office hours. Additional charges may apply on Sundays, holidays and non-office hours. We will notify you if additional delivery charges occur, or you can contact us for details.
4.3. Generally, we will complete the delivery of small packaging orders within 14 days after payment, and the delivery of large product orders within 30 days. But due to unforeseen events, delivery delays sometimes inevitably occur.
4.4. For delivery, we will deliver as close to your requested location as possible. If this location cannot be reached for any reason (such as narrow streets, multi-story stairs, or any other obstruction), the delivery will instead be as close to your location as possible. We strongly recommend that you arrange for at least 2 healthy people to pick up and transport the goods inside.
4.5. We will agree with you a delivery date, usually within 14 working days for small products and 30 working days for large products and/or special orders. We will strive to deliver within the stipulated time.
4.6. Occasionally goods are subject to out-of-stock and/or customs clearance, and other deliveries are delayed, which is beyond our control. Therefore, we cannot guarantee the exact delivery date and the delivery date specified by us is only an approximate date. If our suppliers or us are temporarily out of stock, we will notify you of the situation; you should allow late shipments unless you wish to cancel the order and get a refund.
4.7. The risk of the product will be borne by you from the date of your acceptance of the goods.
4.8. If you are unable to collect the goods on the day agreed upon by us, please notify us at least 24 hours before the scheduled delivery date. If you do not notify us within this time and we are unable to deliver the shipment to your delivery location on the scheduled date and time, we will recycle the shipment and reserve the right to charge a second shipping fee.
4.9. During delivery of the Goods, you shall inspect Your Goods for any damage or missing parts or components as soon as reasonably practicable. After delivery, we will provide you with a delivery note, you should note any issues on the delivery note and we will ask you to sign the delivery note.
4.10. In the event of any accidental damage to your property by our delivery team, you must notify Proflex as soon as reasonably practicable. If possible, you should inform Proflex of the damage on site and note it on the delivery note.
5. Cancellation of order
5.1. If for any reason you are not completely satisfied with the item, you have the right to cancel the order and request a refund before shipment.
5.2. If there is a quality problem with the item, you can cancel the order and request a refund. Returned goods must be complete and unused.
5.3. If we find that the value of the returned item has decreased, the returned payment will be reflected accordingly.
5.4. You should return the Goods to us within 14 days of notifying us that you wish to return the Goods.
5.5. You may report to us the order you intend to cancel using the contact form or email.
5.6. You are legally obligated to take care of the Product while in your possession. If you fail to comply with this obligation, we may refuse to return the product or refund.
6. Refund
6.1. For products with product quality problems, we will check in detail and notify you of refund arrangements by email within a reasonable time. We will usually process your refund as soon as possible (usually within 14 days).
6.2. We will not accept cancellations and/or refunds for any defects caused by you or your customers or agents.
6.3. We will normally refund the money to you using the same payment method that you originally used to purchase the Product.
7. Warranties and Guarantees
7.1. In addition to your statutory rights, all products offered are subject to the manufacturer’s warranty terms. This guarantee specifically excludes failures due to accident, neglect, misuse or normal wear and tear; in addition, there are routine maintenance consumables. The manufacturer may not be able to provide any warranty if the product is used in a non-domestic setting, such as in the workplace.
8. Data Protection
8.1. In order to prevent unauthorized access to the data you provide to us, we follow strict security procedures when storing and disclosing information.
9. Spot inventory
9.1. Although we ensure the supply of products is in stock, sometimes the supply of products may be broken, damaged, incorrectly stocked. You will be asked for permission to wait for the stock to arrive or cancel the order. If you choose to cancel, all payments made will be refunded in full.
10. DISCLAIMER AND LIMITATIONS OF PROFLEX EQUIPMENT LIMITED
10.1. We take great care to ensure product stock availability. However, sometimes products may be broken, damaged or incorrectly stocked from the supplier. You can request to wait for stock to arrive or cancel an order in such an event. If you choose to cancel your order, any payments made will be fully refunded.
11. Ownership of Submissions
11.1. All comments, gift messages, blogs, feedback, suggestions, questions, ideas, artwork, images, product or marketing ideas and any other disclosures, submissions, other than Personal Data (subject to our Privacy and COOKIE Policy) or provided and posted to Proflex through the website, or otherwise disclosed, submitted or made available to Proflex (collectively, “Submissions”), once submitted, will become the property of Proflex and will be reserved in advance. You must comply with the content standards set forth in these Terms. You warrant that you own or have the right to use any Submission and that your Submission will comply with these standards and guidelines.
